Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his return to the United States to face human smuggling charges, he was held in immigration custody.
In her order, the judge noted that the authorities lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve conflicting claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.
